AstraZeneca has agreed to pay $3.5 million to settle a lawsuit filed against Astraventus (which is owned by Merck & Co).
The lawsuit, filed in the U. S. District Court in New York against Merck & Co. and the company in the United Kingdom, alleged that AstraZeneca’s drug Crestor caused heart attacks, strokes and other adverse events. The suit was brought by former AstraZeneca sales rep in New York who alleged that AstraZeneca was negligent for failing to warn of the risks associated with its drug. The suit sought damages for the company’s failure to provide adequate warnings and treatment for patients who suffered adverse events, and for damages resulting from the defendants’ negligence.
“The litigation is an important one for the American public,” said Steven Nissen, AstraZeneca’s executive vice president and chief executive officer. “The resolution of this case has resulted in a major victory for the company in light of the important steps it has taken to recover.”
The AstraZeneca lawsuit was filed in the U. District Court in New York in March and has been scheduled to be heard in the first quarter of 2006. The suit was filed against Merck in May 2003.
The lawsuit alleges that AstraZeneca had “certain assurances” of the Crestor risks it was taking when it failed to adequately warn patients of the dangers associated with the drug.
